What do Italian courts say?
Finally, concrete signs are coming from civil and commercial Italian courts of justice, as far as mediation is concerned.
Several judgments have recently been penalizing parties who have “ignored” mandatory mediation sessions. Amongst them, the decision of the court of Lamezia Terme, which ordered the plaintiff to pay legal fees to the defendant, since court proceedings were initiated without first attending mediation (22 June 2012).
In another case, the civil court of Siena stated that the mere filing of mediation papers (without an effective participation to the process) does not satisfy the condition of admissibility of a claim subject to mandatory mediation, and therefore....
